When someone is injured in an accident, the last thing they are thinking of is what should I do so that everything is in order when I am being deposed in a deposition or being questioned at trial 12-36 months later. Depending on the type of accident your involved in, you should:

  • Call the police and inform them of the happening of the accident
  • Call the EMS and/or FDNY
  • Seek medical attention
  • Although not at fault, it may come as second nature for some to say “sorry” that the accident happened. DON’T DO THIS as that could be construed as a statement against your interest.
  • Depending on the type of accident, take pictures of the scene, the condition that caused your accident and/or the vehicles involved
  • Collect information from all witnesses present at the time of the accident who were either involved in the accident or witnessed any part of the incident.
  • Don’t allow any employer or supervisor to force you to tell EMS or ER personnel that the accident happened in a way that is contrary to the truth.

Yes there is - In New York, the statute of limitations as it relates to certain actions is;

  • Personal injury (Non-Municipal) – 3 years from the date of the accident.
  • Personal Injury involving the City of New York and the Municipalities - a Notice of Claim needs to filed within 90 days of the accident and a Lawsuit is to be filed within 1 year and 90 days of the accident.
  • Wrongful Death - two years from the date of the death.
  • Medical Malpractice - two years and six months from the date of the malpractice or from the end of continuous treatment rendered by the party or entity you intend to sue for a particular condition, illness or injury.
  • Emotional Distress (negligent) – 3 years
  • Emotional Distress (Intentional) – 1 year
  • Products Liability – 3 years from the date of accident

A personal injury action generally involves two things (i) Who is at fault? Aka “Liability”; and (ii) What are the damages, the injury, the pain and suffering and the harms and losses as a result of the incident/occurrence?
