Yes there is - In New York, the statute of limitations as it relates to certain actions is;

  • Personal injury (Non-Municipal) – 3 years from the date of the accident.
  • Personal Injury involving the City of New York and the Municipalities - a Notice of Claim needs to filed within 90 days of the accident and a Lawsuit is to be filed within 1 year and 90 days of the accident.
  • Wrongful Death - two years from the date of the death.
  • Medical Malpractice - two years and six months from the date of the malpractice or from the end of continuous treatment rendered by the party or entity you intend to sue for a particular condition, illness or injury.
  • Emotional Distress (negligent) – 3 years
  • Emotional Distress (Intentional) – 1 year
  • Products Liability – 3 years from the date of accident
